About these Terms
These Terms govern your use of toddhq.com (the “Site”), operated by Todd & Co. Armament LLC, an Arizona limited liability company doing business as Todd HQ (“Todd HQ,” “we,” “us”). By using the Site, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.
What we sell
Todd HQ sells firearm accessories, parts, ammunition, and black powder (muzzleloading) firearms. Our products include optics, sights, weapon lights, mounts, rail accessories, slings, holsters, magazines, triggers, slides, parts and conversion kits, ammunition, and black powder rifles and pistols. We do not sell modern firearms, frames or receivers, or any item that requires an FFL transfer, and we do not perform gunsmithing.
Eligibility and lawful use
- You must be at least 18 years old to use the Site or place an order. You must be at least 21 years old to buy handgun ammunition or black powder pistols, and older where state or local law requires it.
- You are responsible for knowing and following all federal, state and local laws that apply to buying, possessing, carrying and using the products you purchase. Some accessories may be restricted in certain states or localities.
- By placing an order, you confirm that you are legally allowed to buy, possess and receive every item you ordered at the shipping address. Some products, including ammunition, black powder firearms, magazines, triggers and certain parts, are restricted or prohibited in some states, cities and counties. We may cancel any order we believe would violate the law and will refund what you paid. We may ask for proof of age or identity before shipping.
- We may refuse or cancel any request or order, or decline to ship to any location, where we believe the sale or shipment may be unlawful or inappropriate.
- You agree not to misuse the Site, including by attempting to interfere with its operation, submitting false information, or sending spam through our forms.
Product information
We try to describe products accurately, but product details, specifications, images and compatibility information often come from manufacturers and may change without notice or contain errors. Brand names shown on the Site are used to identify the products we offer or can source; listing a brand does not mean Todd HQ is affiliated with, sponsored by or endorsed by that brand. Always confirm that a product is compatible with your equipment before use.
Product requests and quotes
Submitting the contact form or requesting a product is not an order and does not create a binding contract. Any price, availability or lead time we provide in response is an estimate until we confirm an order with you in writing. Prices and availability can change, especially for items we source from distributors.
Orders, payment and shipping (online store)
The following terms apply to purchases from our online store, along with any terms shown at checkout:
- Order acceptance. An order is accepted only when we confirm it or ship it. We may limit quantities and may cancel orders affected by pricing errors, stock issues, suspected fraud, or legal restrictions. If we cancel after you’ve paid, we will refund you.
- Pricing and taxes. Prices are in U.S. dollars. Applicable sales tax (including Arizona transaction privilege tax) and shipping charges are added at checkout.
- Payment. Payments are processed by Gearfire Payments through the Fortis payment gateway; we do not store full card numbers.
- Shipping. We ship only within the United States, by UPS, FedEx or USPS. We do not ship any orders to California, Massachusetts, the District of Columbia or New York City, and orders to those areas will be cancelled and refunded. Most orders arrive in 3 to 10 business days, but delivery dates are estimates. Some orders ship directly from our distributors, so items in one order may arrive in separate packages and from different addresses. We do not ship ammunition to Alaska, California, the District of Columbia, Hawaii, Massachusetts, New York, New York City, U.S. territories or PO boxes. Ammunition ships ground, and an adult signature is required on delivery where the law calls for it, including all ammunition orders shipped to Colorado. A minimum order subtotal may apply, as shown at checkout. Risk of loss passes to you when the carrier delivers your order.
- Returns. Our Return Policy applies to all store purchases.
Manufacturer warranties
Products are covered only by the warranties, if any, provided by their manufacturers. We will help point you to the manufacturer’s warranty process when we can. Todd HQ does not make any separate warranty unless we state it in writing.
Safe use
Firearm accessories must be mounted, adjusted and used according to the manufacturer’s instructions and safe firearm-handling practices. You are solely responsible for how you mount and use any product you buy. If you’re unsure about compatibility or setup, consult the manufacturer or a qualified professional.
Disclaimers
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Todd HQ disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, regarding the Site and its content. We don’t guarantee that the Site will always be available or error-free.
Limitation of liability
To the fullest extent permitted by law, Todd HQ and its owners, members and employees will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or any product. Our total liability for any claim related to a product or order will not exceed the amount you paid us for that product or order. Some states don’t allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to defend, indemnify and hold harmless Todd HQ from any claims, losses or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or any product, or your violation of these Terms or any law.
Intellectual property
The Todd HQ and Todd & Co. Armament names, logos, mascot artwork, photos and Site content belong to Todd & Co. Armament LLC and may not be copied or used without our permission. Third-party brand names and trademarks belong to their respective owners.
Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Arizona, and you consent to the jurisdiction of those courts.
Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continued use of the Site after changes are posted means you accept the updated Terms.
